ADA Pool Lift Compliance Date Extended
The Department of Justice in response to the urging of CLIA, the Independent Lodging Industry Association (ILIA) and other lodging industry groups has announced a delay in the implementation of ADA compliance for pool and spa lifts until January 31, 2013.
According to the DOJ: "On May 18, 2012, the Department announced that it is adopting a final rule extending the compliance date for sections 242 and 1009 of the 2010 Americans with Disabilities Act (ADA) Standards for Accessible Design, as they relate to the provision of accessible entry and exit to existing swimming pools, wading pools, and spas (pools built before March 15, 2012). These provisions for existing pools of title II and title III entities will now take effect on January 31, 2013. The final rule does not affect the March 15, 2012 effective date for newly constructed or altered pools."
CLIA and ILIA have been in communication with DOJ regarding the interpretation of the regulations, the financial burden of the regulations and their safe implementation. The extension of the implementation deadline does not impact the "fixed" nature of the regulations. The delay is intended to inform constituents about their obligations under the 2010 standards.
CLIA and ILIA will continue to work on behalf of its members in the implementation of fair and equitable ADA regulations that offer excellent service to all travelers.
